At Vida En España, we respect the intellectual property rights of others and expect our users to do the same. If you are a copyright owner and believe that your work has been copied in a way that infringes your rights, you may submit a notification under the Digital Millennium Copyright Act (DMCA).
This page outlines the process for copyright owners to submit a complaint under the DMCA, including the steps to file a notice and the required information.
1. Copyright Infringement Notification
If you believe that your work has been copied in a way that violates your copyright, please send us a notification containing the following information:
- Your electronic or physical signature, or that of a person authorized to act on your behalf.
- Identification of the copyrighted work you claim has been infringed. If multiple works are included in a single notice, provide a representative list.
- Identification of the material that you claim is infringing and that should be removed or blocked, including enough detail for us to locate the material.
- Sufficient contact information for the complaining party, such as email address, phone number, or other means of communication.
- A statement made in good faith that the use of the material in the manner claimed is not authorized by the copyright owner, their agent, or the law.
- A statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
2. Counter-Notification
If you believe that material that was removed or blocked does not infringe your copyright, you may submit a counter-notification. This must include:
- Your electronic or physical signature.
- Identification of the material that was removed or blocked, including its original location before removal.
- A statement under penalty of perjury that you believe in good faith that the material was removed or blocked due to mistake or misidentification.
- Your full name, address, phone number, and email address.
- A statement under penalty of perjury accepting the jurisdiction of the federal courts of Spain and consenting to service of process via the provided email address.
3. Submitting Notices and Counter-Notices
Only submissions that contain all required DMCA information will be processed. Incomplete notices or counter-notices will not be considered valid.
4. Effects of the DMCA
Under the DMCA, upon receiving a valid copyright infringement notice, we will take appropriate actions, such as removing or disabling access to the infringing material. Upon receiving a valid counter-notification, we will restore access to the material unless a subsequent notice indicates that a legal claim has been filed.
